Terms of Use

1. Who we are

Hotwebinar is an automated webinar platform operated by HOTWEBINAR DESENVOLVIMENTO E COMERCIALIZACAO DE PLATAFORMAS ONLINE LTDA, registered under CNPJ 50.601.987/0001-78, with its principal office at Rua Teófilo Otoni, 63, sobreloja 201, Centro, Rio de Janeiro/RJ, CEP 20090-080, Brasil ("Hotwebinar", "we", "us").

In these Terms, "you" or "Customer" means the individual or company that creates an account and uses the platform. "Participants" means the people who watch the Customer's webinars.

2. The service

Hotwebinar lets you record, host and stream automated webinars, with features such as simulated chat, an AI agent, purchase notifications, simulated audience, A/B testing, replay, integrations and analytics.

The features and limits of each plan (viewers, concurrent webinars, agents, storage, usage and AI tokens) are those described on the pricing page at the time of purchase. We may improve, change or discontinue features, giving reasonable advance notice when a change materially reduces what you purchased.

3. Account and access

You must provide accurate information and keep your login credentials confidential. You are responsible for all activity on your account, including by any agents and users you invite.

To subscribe, you must have the legal capacity to enter into contracts or to act on behalf of the company you represent.

4. Free trial, plans and payment

Plans may include a 7-day free trial with full access. To start the trial, we ask for a credit card. If you do not cancel before the trial ends, your subscription begins and the first charge is automatically made to the card provided.

Subscriptions are monthly or annual, billed in advance and automatically renewed for the same period until you cancel. Prices are shown in your local currency when available; taxes and fees from your bank or card issuer may be charged separately.

Payments are processed by payment partners, such as Stripe and Hotwebinar's Brazilian checkout. We do not store your full card details.

If a payment fails, we may retry the charge and, if non-payment persists, suspend access until the account is brought current.

We may change prices for future renewals, with advance notice. The change does not affect any period you have already paid for.

5. Cancellation and refunds

You may cancel at any time from your dashboard or by contacting our support team. If you cancel during the trial, you are not charged. If you cancel afterwards, access continues until the end of the period already paid for and you will not be charged again.

Where applicable law grants a right of withdrawal or a refund (for example, the 7-day period under the Brazilian Consumer Protection Code for purchases made online, where applicable), that right will be honored. Outside those cases, amounts for periods that have already begun are not refunded.

6. Acceptable use

You agree not to use Hotwebinar for: illegal, defamatory or discriminatory content, or content that infringes the rights of third parties; spam or unauthorized communications; fraud, scams, pyramid schemes or misleading promises of earnings; distribution of malware; or any attempt to circumvent the security or limits of the platform.

Features such as simulated chat, simulated audience and purchase notifications are presentation tools. You are solely responsible for using them in compliance with the consumer protection, advertising and data protection laws of your country and of your Participants' countries, including disclosing that the event is pre-recorded or automated where required.

We may suspend or terminate accounts that violate these Terms, with prior notice whenever possible.

7. Your content and Participant data

The videos, text, offers and other materials you upload remain yours. You grant us a limited license to store, process and display them only to the extent necessary to provide the service.

You represent that you hold the necessary rights to that content and you are responsible for it.

With respect to the personal data of your Participants (name, email, phone number, interactions), you are the controller and Hotwebinar acts as a processor, processing that data solely to provide the service, in accordance with our Privacy Policy.

8. Intellectual property

The platform, the Hotwebinar brand, the software, the design and the Hotwebinar Community materials belong to us or our licensors. Your subscription gives you the right to use them while it is active, without transferring ownership.

9. Availability and support

We work to keep the platform available and secure, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be announced whenever possible.

Support is provided through the channels listed on the website, on business days, during the stated hours.

10. Limitation of liability

Hotwebinar provides tools; sales results depend on your product, offer, traffic and audience, and are not guaranteed. Figures cited on the website are real customer examples, not promises of results.

To the maximum extent permitted by law, we are not liable for lost profits or indirect damages, and our total liability is limited to the amount you paid in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits rights guaranteed by consumer law that cannot be waived.

11. Changes to these Terms

We may update these Terms. We will give advance notice of material changes by email or in the dashboard. Continuing to use the platform after the changes take effect means you agree to the new version.

12. Governing law and contact

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Rio de Janeiro/RJ are chosen as the venue, without prejudice to the consumer's right to bring an action in their place of residence.
